The Immigrant Investor Pilot Program/移民投资试点项目

 

The Immigrant Investor Pilot Program ("Pilot Program") was created by Section 610 of Public Law 102-395 (October 6, 1992). The Pilot Program began in accordance with a Congressional mandate aimed at stimulating economic activity and creating jobs for U.S. workers, while simultaneously affording eligible aliens the opportunity to become lawful permanent residents. Through this innovative program, foreign investors are encouraged to invest funds in an economic unit known as a "Regional Center".

 

移民投资试点项目（简称“试点项目”）于1992年十月6号创建并被列为公法102-395第610条。试点项目由国会授权，旨在鼓励经济活动，为美国工人创造就业机会，同时给予有资格的外国人成为永久合法居民的机会。通过这一创新计划，鼓励外国投资者在经济单位即区域中心投资资金。

 

Regional Center

A "Regional Center" is defined as any economic unit, public or private, engaged in the promotion of economic growth, improved regional productivity, job creation, and increased domestic capital investment. It is an entity, organization, or agency that has been approved as such by the United States Citizenship and Immigration Services (USCIS).

投资移民方案就是指美国移民法中EB-5这项移民签证类别,简称EB-5. (Employment Based Preference)是美国移民法中针对海外投资移民申请人所设立的移民类别.此类别的投资门坎一般订为100万美元,如果投资的个案是位于符合国家统计资料中的低就业地区,则此投资门坎还可降为50万美元.外国移民申请人籍由投资100万或50万美元于美国境内的一个企业,并创造十个就业机会,即可取得两年期的条件式绿卡.

EB-5 Investor Program

Under the EB-5 Investor Program, an alien must invest at least $1,000,000, or at least $500,000 where the investment is being made in a "targeted employment area," which is an area that has experienced unemployment of at least 150 per cent of the national average rate. In order to seek status as an immigrant investor, you must file USCIS Form I-526, Immigrant Petition by Alien Entrepreneur. The Form I-526 must be filed with supporting documentation which clearly demonstrates that the individual’s investment meets all requirements, such as:

EB-5对申请人的资格条件指定相对宽松,投资人无须受任何商业背景、年龄、教育程度及语言能力的条件限制,只要证明其投资金额的来源是合法取得即可.并且此资金不限定要通过自己努力经营企业所赚得,亦可经由继承或赠予取得.此移民类别的另一大特色是「全家移民」,亦可投资人、其配偶及未满21岁之未婚子女均可同时申请移民.作为一个移民投资者，要想获得居民身份，必须填写美国公民及移民服务局的外国企业家移民申请表1-526，此表格需要投资者提供可以证明个人的投资符合所有要求的具有说服力的文件，例如：

  • Establishing a new commercial enterprise / 建立新的商业企业
  • Investing the requisite capital amount / 投资所需的资本额
  • Proving the investment comes from a lawful source of funds/ 证明投资的资金是合法的
  • Creating the requisite number of jobs/ 创造所需数量的就业机会
  • Demonstrating that the investor is actively participating in the business; and, where applicable, creating employment within a targeted employment area/ 投资者积极参加商业活动，并有能力在指定就业区创造就业机会

This is an at-risk investment. Each prospective EB-5 investor should consider carefully the risk factors attendant to this investment and should consult his or her own legal, real estate, and financial advisors with respect thereto.
